Terms and Conditions of Use

Please read these Terms and Conditions of Use carefully (hereinafter, the "Terms") before using the website and application accessible from cervantes.training (hereinafter, the "Service"). Accessing, registering for, or using the Service implies that you have read, understood, and fully and unreservedly accepted these Terms. If you do not agree with any of their clauses, do not use the Service.
The Service is owned by Cesar Ramos, with registered address at 26/21 Bombery Street, Cannon Hill, QLD 4170, Australia (hereinafter, the "Owner"). For any communication relating to these Terms, you may write to info@cervantes.training.
1. Purpose and description of the Service
The Service is an educational and self-learning tool that allows users to practise multiple-choice questions, take mock exams, review mistakes, and consult progress statistics, aimed at preparing for knowledge tests such as the CCSE exam (Knowledge of the Spanish Constitution and Society — Conocimientos Constitucionales y Socioculturales de España).
The Service is purely educational in nature and intended as a study aid. It does not constitute legal, administrative, academic, or professional advice of any kind, nor does it guarantee the achievement of any result, grade, certificate, qualification, nationality, or administrative authorisation.
2. Absence of affiliation and unofficial nature
The Service is an independent project. It is NOT affiliated with, associated with, authorised by, endorsed by, or connected in any way to the Instituto Cervantes, the competent Ministry, the Directorate-General for Legal Certainty and Public Attestation, or any public or official body responsible for nationality exams, certificates, or procedures.
Any third-party names, trademarks, trade names, and logos that may appear belong to their respective owners and are used, where applicable, solely for descriptive or informational purposes. The name of the Service must not be interpreted as an indication of official origin.
The questions, contents, and preparation materials are not the official exams, may not match them, and may become outdated. The exams, their contents, and their criteria are governed exclusively by the official sources and bodies, which prevail in all cases.
3. Content generated with artificial intelligence. Possibility of errors
THE USER EXPRESSLY ACKNOWLEDGES AND ACCEPTS that a substantial part of the Service —including, without limitation, questions, answers, explanations, translations, texts, classifications, and other content— has been created, generated, assisted, or maintained by means of artificial intelligence (AI) systems and automated processes.
As a result, the content MAY CONTAIN ERRORS, INACCURACIES, OMISSIONS, INCORRECT ANSWERS, OUTDATED INFORMATION, OR MISLEADING STATEMENTS. The Owner does not review and cannot guarantee the accuracy, completeness, currency, or suitability of any content.
The User undertakes to ALWAYS VERIFY, BY THEIR OWN MEANS AND THROUGH THE OFFICIAL SOURCES, any information obtained through the Service before using it, memorising it, or basing any decision on it. The User assumes all responsibility arising from their use of the content. The Owner shall not be liable for the consequences of relying on erroneous, incomplete, or outdated information.
4. Service "as is" and exclusion of warranties
The Service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law.
The Owner does not warrant that the Service is accurate, reliable, complete, uninterrupted, secure, error-free, or free of viruses, nor that it will be available at all times, nor that it will meet the User's expectations or needs, nor that the results obtained from studying through the Service will be sufficient to pass any test.
Any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement is excluded to the maximum extent permitted by law.
5. Limitation of liability
To the maximum extent permitted by applicable law, the Owner, its collaborators, and suppliers shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages or losses of any kind (including, without limitation, loss of opportunities, loss of study time, failing or not obtaining an exam, certificate, or authorisation, loss of data, non-pecuniary damages, or loss of profit) arising out of or relating to the access, use, or inability to use the Service or its content, even if advised of the possibility of such damages.
Since the Service is offered free of charge, the User acknowledges that, to the maximum extent permitted by law, the Owner's total and aggregate liability towards the User for any claim relating to the Service is limited and shall not exceed the amount actually paid by the User for the Service during the twelve months preceding the event giving rise to the claim, which in the case of a free service is zero (0) euros.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, such as liability arising from wilful misconduct or from damage to life or physical integrity caused by gross negligence. Certain jurisdictions do not permit certain exclusions or limitations of liability; in such case, these shall apply to the maximum extent permitted by law.
6. Registration, account, and security
Some features require the creation of an account. The User undertakes to provide truthful, accurate, and up-to-date information, and to keep it so. Registration is reserved for persons over fourteen (14) years of age; if you are under that age, you must not register or use features that require an account.
The User is solely responsible for the safekeeping and confidentiality of their access credentials and for all activity carried out through their account. The User must immediately notify the Owner of any unauthorised use.
To create an account, it is necessary to tick the box accepting these Terms and the Privacy Policy. Such acceptance is recorded electronically, together with its date and the version accepted, as proof of the consent given.
7. Acceptable use
The User undertakes to use the Service in accordance with the law, good faith, public order, and these Terms. In particular, the User shall refrain from: (a) using the Service for unlawful or unauthorised purposes; (b) accessing or attempting to access without authorisation any systems, accounts, or data; (c) introducing malicious software or interfering with the operation of the Service; (d) extracting, copying, reproducing, or exploiting the content in a massive or automated manner (scraping); (e) impersonating third parties; or (f) carrying out any action that overloads or harms the Service's infrastructure.
Breach of these rules may give rise to the immediate suspension or cancellation of the account, without prejudice to any other applicable actions.
8. Intellectual and industrial property
Except for third-party content and materials of official origin, the software, design, structure, original texts, and other elements of the Service are protected by intellectual and industrial property rights owned by or licensed to the Owner.
The User is granted a limited, personal, non-exclusive, non-transferable, and revocable licence to use the Service for personal and non-commercial study purposes. No other right is assigned. The reproduction, distribution, public communication, transformation, or commercial exploitation of the Service or its content without prior written authorisation is prohibited.
9. Availability, modifications, and third-party links
The Owner may modify, suspend, limit, or discontinue the Service, in whole or in part, on a temporary or permanent basis, at any time and without prior notice, without this giving rise to any right to compensation.
The Service may contain third-party links or integrations (for example, hosting, analytics, or notification providers). The Owner does not control and is not responsible for the contents, policies, or practices of such third parties.
10. Indemnification
The User undertakes to hold the Owner harmless against any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising from their use of the Service in breach of these Terms or applicable law, or from the infringement of third-party rights.
11. Modification of the Terms
The Owner may modify these Terms at any time. The version in force shall be the one published on the Service, indicating its date of update. Continued use of the Service after the publication of changes implies acceptance of the modified Terms. When changes are substantial, reasonable efforts will be made to inform users by reasonable means.
12. Suspension and termination
The User may stop using the Service and request the deletion of their account at any time. The Owner may suspend or cancel the User's access, with or without cause, in particular in the event of a breach of these Terms. Clauses that by their nature must survive (liability, intellectual property, applicable law, etc.) shall remain in force after termination.
13. Data protection
The processing of the User's personal data is governed by the Privacy Policy, which forms an integral part of these Terms and which the User declares to know and accept.
14. Partial invalidity, integrity, and waiver
If any clause of these Terms is declared null or unenforceable, such invalidity shall not affect the rest, which shall retain its full validity, and the affected clause shall be interpreted or replaced to the extent necessary to preserve the intention of the parties. The Owner's failure to exercise a right shall not constitute a waiver thereof.
15. Applicable law and jurisdiction
These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the Owner's domicile, unless consumer and user protection legislation mandatorily provides for another forum, in which case the provisions of such legislation shall apply.
